Community Asset Transfer lease negotiations

In any community asset transfer there will be a process of negotiation between the local authority and the community group seeking to acquire the asset.

This document sets out a number of key issues to consider which have arisen in our experience when negotiating a lease from the public authority to a community group or third sector recipient for the transfer of a community asset, most commonly under the ‘community asset transfer’ regime. Please note, the implications of any commercial property arrangements that community groups may choose to enter into are outside of the scope of this guidance.
